Disclosure of Terms of Sales 

MLS has received questions about the reporting of the terms of sales that might affect a property value and the completion of appraisal forms that request details of a sale.  The MLS requires certain data to be reported – sales date, sales price and type of financing.  Most of this information is non-confidential and available from various sources.  The MLS also permits, and encourages, the entry of “remarks” on listing sales that could affect the sale of the property - this would include buyer and seller negotiated concessions or other terms of the sale.  No confidential information should be published through the MLS without proper authorization nor should it be released to anyone without such authority.

The Realtors® Code of Ethics at Standard of Practice 1-9 states (in part), “The obligation of Realtors® to preserve confidential information (as defined by state law) provided by their clients in the course of any agency or non-agency relationships continues after termination of those relationships.”

Provide what information you can to assist your fellow brokers, agents and appraisers.

Keep Your Password Secure

The MLS recently received concerns from a few members regarding access to the MLS.  It seems that a non-member was soliciting members for their user name and password so they could access the MLS for “research purposes”.   In exchange for this access they (the non-member) would supply them (the member) with potential business or payment.  Essentially they want MLS the information you pay for with your Association and MLS fees!

Please remember to keep your password secure.  DO NOT give it to anyone – friends, neighbors, buyers, sellers, etc. Your breach of security exposes all your listings and content as well as your contacts to prying eyes.  Providing non-members access to the MLS may result in hefty sanctions and possible loss of MLS membership.    If you know of anyone providing access to the MLS inappropriately please contact Lynne at the MLS at lynne@metromls.com.
